Re-entry Permit and Special Re-entry Permit

日本に在留する外国人が、いったん海外に出ると、在留資格、在留期間は消滅します。再度日本に入国するためには、再び入国・上陸の手続をしなければなりません。再入国許可、みなし再入国許可は、この不便さを解消するための制度です。再入国許可とは、在留する外国人が、一時的に出国し、再度入国しようとする場合に、入国・上陸手続を簡略化するために法務大臣が出国に先立って与える許可です。これを受けた外国人は、再入国の上陸申請の際に査証が免除され、従前の在留資格、在留期間が継続しているものとみなされます。再入国許可は、１回限り有効のものと、有効期間内であれば何回も使用できる数次有効のものがあります。有効期間は、現に有する在留期間の範囲内で、５年間（特別永住者は６年間）を最長として決定されます。また、中長期在留者が、出国の日から１年以内（特別永住者は２年間）に再入国する場合は、原則として再入国許可を受ける必要はありません。有効な旅券及び在留カード（特別永住者の場合は特別永住者証明書）を所持し、出国時に入国審査官に対して再び入国する意図があることを告げることで、通常の再入国許可を受けたものとみなされます。

If a non-Japanese resident leaves Japan temporarily, his or her visa status and authorized period of stay shall be revoked. Such a resident must go through immigration and disembarkation procedures in order to enter Japan again. Re-entry permits and special re-entry permits are a system intended to eliminate this inconvenience. A re-entry permit is issued by the Minister of Justice prior to the holder’s departure from Japan in order to simplify immigration and disembarkation procedures when the holder temporarily leaves Japan and then wants to re-enter. A non-Japanese resident who receives this permit does not have to obtain a new visa when requesting disembarkation upon re-entry and continues to retain his or her existing visa status and authorized period of stay. There are two types of re-entry permits: a one-time re-entry permit that may only be used once, and a multiple re-entry permit that may be used an unlimited number of times until the permit expires. The validity of a re-entry permit lasts as long as the holder’s current authorized period of stay, with a maximum validity of 5 years (or 6 years for special permanent residents). In addition, if a mid- to long-term resident re-enters Japan within 1 year of his or her date of departure (or 2 years for a special permanent resident), in principle there is no requirement to obtain a re-entry permit. If said resident carries a valid passport and Residence Card (or certificate of special permanent residency in
case of a special permanent resident) and, at the time of departure declares to the immigration inspector his or her intention to re-enter Japan, then the resident shall be considered permitted to re-enter Japan.
